NEUFORM 8 Week Challenge Terms and Conditions

These Terms and Conditions apply to the NEUFORM 8 Week Challenge operated by Chontel Pty Ltd trading as NEUFORM, ABN 76 625 118 854.

By purchasing, accessing, joining, using or participating in the NEUFORM 8 Week Challenge, you agree to these Terms and Conditions.

If you do not agree to these Terms and Conditions, you must not purchase, access, join, use or participate in the Challenge.

1. Definitions

In these Terms:

NEUFORM, we, us or our means Chontel Pty Ltd trading as NEUFORM, ABN 76 625 118 854.

Challenge means the NEUFORM 8 Week Challenge, including all related meal plans, calories, macros, recipes, training programs, seminars, webinars, livestreams, check-ins, in-app chat support, community forum access, prizes, giveaways, app access, resources and related content.

Participant, you or your means any person who purchases, accesses, joins, uses or participates in the Challenge.

Content means all materials provided by NEUFORM, including meal plans, recipes, macros, training programs, videos, livestreams, seminar content, educational resources, PDFs, app content, forum content, written guidance, graphics, text, images, templates and other materials.

Support means support provided by NEUFORM through in-app chat and email.

2. Eligibility

The Challenge is available to people aged 18 years and over only.

By purchasing or participating in the Challenge, you confirm that:

a. you are at least 18 years old;

b. all information you provide to NEUFORM is true, complete, accurate and not misleading;

c. you are physically and mentally capable of participating in a nutrition and training challenge;

d. you are responsible for obtaining medical clearance before participating; and

e. you understand that the Challenge is not a medical, dietetic, psychological, emergency or clinical health service.

NEUFORM may refuse, pause, modify, suspend or cancel your participation if we reasonably believe the Challenge may be unsuitable, unsafe, outside our scope, or inappropriate for you.

3. What the Challenge Includes

The Challenge may include:

a. a personalised meal plan;

b. unlimited reasonable meal plan changes and adjustments during the 8 week access period;

c. personalised calories and macros;

d. recipes;

e. training programs;

f. seminars and webinars;

g. livestreams;

h. check-ins;

i. in-app chat support;

j. access to a community group forum;

k. app access for the Challenge period;

l. prizes or giveaways for one or more winners; and

m. other resources, content or support NEUFORM decides to include.

NEUFORM may change, update, remove, replace, reschedule, substitute or modify any part of the Challenge at any time, including seminars, livestreams, training programs, recipes, meal plan format, prizes, support methods, app features, community access and resources, provided we do not remove your rights under Australian Consumer Law.

4. Challenge Access Period

Your Challenge access runs for 8 weeks from the date you receive access to the Challenge or app, unless NEUFORM agrees otherwise in writing.

If you delay completing onboarding forms, health questionnaires, check-ins or other required steps, this may delay your meal plan, macros, check-ins, adjustments or support. Delays caused by you do not automatically extend your 8 week access period.

NEUFORM may choose to extend access at its sole discretion, but is not required to do so unless required by law.

5. Price, Payment and Stripe

The Challenge is sold as a one-off payment.

The Challenge price is $299 AUD when paid upfront through Stripe or the website checkout.

All prices are in Australian dollars unless stated otherwise.

Payment must be received before access is provided.

Payments are processed by Stripe, a third-party payment processor. By making payment, you authorise NEUFORM and Stripe to charge your selected payment method for the total amount shown at checkout.

You must provide current, complete and accurate payment information. You confirm that you are authorised to use the payment method provided.

NEUFORM does not store your full credit card or debit card details. Payment information is processed by Stripe in accordance with Stripe's own terms, privacy policy and payment processing systems.

You acknowledge that Stripe may process payment information, transaction information, fraud prevention information, device information and other information required to process and verify payments.

NEUFORM is not responsible for any loss, delay, error, failed transaction, declined payment, bank fee, card fee, foreign exchange fee, third-party fee, account restriction, payment hold, Stripe outage, payment provider issue or unauthorised transaction caused by Stripe, your bank, card issuer, payment provider or another third party.

If your payment is declined, reversed, disputed, refunded, charged back or otherwise not successfully received, NEUFORM may suspend or withhold access to the Challenge until the matter is resolved.

If you believe a payment has been made in error, you must contact NEUFORM first at support@neuform.au before initiating a chargeback or payment dispute.

If you initiate a chargeback or payment dispute, NEUFORM may provide Stripe, your card issuer, your bank or the relevant payment provider with evidence of your purchase, account access, use of the Challenge, acceptance of these Terms, communications, refund policy and any other relevant information.

Where permitted by law, you are responsible for any loss, cost, fee or charge incurred by NEUFORM as a result of an improper, false, fraudulent or unreasonable payment dispute, chargeback or failed payment.

Third-party payment providers, including Stripe, may have their own terms, conditions, fees, dispute processes, eligibility requirements and privacy practices. NEUFORM is not responsible for the acts, omissions, errors, delays, outages, decisions or policies of third-party payment providers.

6. No Refunds for Change of Mind

Subject to your rights under Australian Consumer Law, NEUFORM does not provide refunds for:

a. change of mind;

b. failure to use the Challenge;

c. failure to complete check-ins;

d. failure to follow the meal plan, macros, training program or guidance;

e. failure to get the result you hoped for;

f. deciding the Challenge is no longer suitable;

g. lack of motivation, time, consistency or personal circumstances;

h. technical issues caused by your device, internet connection, software, account access or third-party platforms;

i. missing seminars, webinars, livestreams or community content;

j. not liking the meal plan, recipes, training program, app, support, format or content; or

k. any reason not required by law.

Nothing in these Terms limits, excludes or modifies any rights you may have under Australian Consumer Law.

If you believe you are entitled to a refund under Australian Consumer Law, contact us at support@neuform.au with your full name, purchase details and the reason for your request.

7. Australian Consumer Law

Nothing in these Terms is intended to exclude, restrict or modify any consumer guarantee, right or remedy that cannot lawfully be excluded, restricted or modified under Australian Consumer Law.

Where we are legally permitted to limit our liability, our liability is limited to one or more of the following, at our discretion:

a. supplying the services again; or

b. paying the cost of having the services supplied again.

This clause does not limit any rights you may have where the law does not allow us to do so.

8. Health, Medical and Scope Disclaimer

The Challenge provides health, fitness, nutrition, meal planning and lifestyle education and coaching.

NEUFORM does not provide:

a. medical advice;

b. dietetic treatment;

c. psychological advice;

d. diagnosis;

e. treatment;

f. urgent health support;

g. emergency assistance;

h. individual healthcare services; or

i. any substitute for your own GP, accredited practising dietitian, psychologist, specialist, physiotherapist or other qualified health professional.

NEUFORM may use qualified professionals, including dietitians, nutrition professionals, health coaches and fitness coaches, to assist with the Challenge. However, NEUFORM does not replace individual medical care, dietetic treatment, psychological care, diagnosis or treatment from your own health professionals.

Any information provided through the Challenge is for general health, fitness, nutrition, meal planning, lifestyle and educational purposes only.

You are responsible for seeking advice from your GP, accredited practising dietitian, psychologist, specialist or other qualified health professional before starting or relying on any NEUFORM guidance, especially if you have any medical condition, injury, pregnancy, breastfeeding status, history of disordered eating, medication use, allergy, intolerance, mental health concern or other health concern.

9. Medical Clearance and Higher-Risk Participants

You must obtain medical clearance before participating in the Challenge if you:

a. are pregnant;

b. are breastfeeding;

c. are trying to become pregnant;

d. have diabetes or blood sugar regulation issues;

e. have heart issues, blood pressure issues or cardiovascular risk factors;

f. have a diagnosed medical condition;

g. have a history of disordered eating or an eating disorder;

h. are taking medication that may be affected by diet, calories, weight loss, exercise, hydration or supplements;

i. have a current or past injury;

j. are recovering from surgery;

k. have a mental health condition that may be affected by diet, training, tracking, body composition goals or weight loss;

l. have allergies, intolerances or dietary restrictions;

m. have been advised not to exercise, diet, restrict calories or lose weight; or

n. are unsure whether the Challenge is suitable for you.

NEUFORM may request written medical clearance from a qualified health professional before allowing you to participate or continue participating.

NEUFORM may refuse, pause, cancel or modify your access if we believe your circumstances make the Challenge unsuitable, unsafe or outside our scope.

10. Participant Responsibility

You are responsible for:

a. ensuring the Challenge is suitable for you;

b. obtaining medical clearance before starting;

c. disclosing all relevant health information honestly and accurately;

d. updating NEUFORM if your health, injury status, medication, pregnancy status, breastfeeding status, mental health or other relevant circumstances change;

e. following advice from your own health professionals;

f. stopping immediately if you feel unwell, unsafe, dizzy, faint, injured, distressed, in pain or experience unusual symptoms;

g. seeking urgent medical help where required;

h. checking all meals, recipes, ingredients and training sessions for your own suitability; and

i. using your own judgment before applying any Challenge guidance.

You must not rely on NEUFORM as your only source of health, nutrition, training, medical or lifestyle advice.

11. Health Questionnaire and Onboarding

You must complete all required onboarding forms, health questionnaires and check-in forms honestly, accurately and completely.

NEUFORM uses the information you provide to assist with meal plan creation, macro targets, training guidance, adjustments, check-ins and support.

If you provide incomplete, inaccurate, false or misleading information, NEUFORM is not responsible for any issue, delay, loss, injury, harm or unsuitable guidance that results from that information.

If you fail to disclose allergies, intolerances, injuries, medications, medical conditions, pregnancy, breastfeeding, eating disorder history, mental health concerns or other relevant information, you participate at your own risk.

12. Meal Plans, Macros and Nutrition Guidance

NEUFORM may provide personalised meal plans, calorie targets, macro targets, recipes and nutrition guidance based on the information you provide.

Meal plans and nutrition guidance are designed to support general health, fitness, body composition and lifestyle goals. They are not medical nutrition therapy, dietetic treatment, diagnosis, clinical care or a substitute for personalised treatment from your own accredited practising dietitian or medical professional.

You are responsible for checking that any meal, recipe, ingredient, calorie target, macro target or nutrition guidance is suitable for you.

You must not follow any meal plan, calorie target or macro target if it conflicts with advice from your GP, dietitian, specialist, psychologist or other qualified health professional.

13. Allergies, Intolerances and Food Safety

You are responsible for checking all meals, recipes, ingredients, brands, food products, labels and preparation methods for:

a. allergies;

b. intolerances;

c. dietary restrictions;

d. choking risks;

e. food safety;

f. food storage;

g. contamination risks;

h. cross-contamination risks;

i. pregnancy or breastfeeding suitability;

j. medication interactions;

k. cultural, religious or personal suitability; and

l. suitability for your household.

NEUFORM is not responsible for any reaction, illness, injury, harm, loss or issue caused by your failure to check ingredients, food labels, preparation methods or suitability.

14. Training and Exercise Disclaimer

The Challenge may include training programs, exercise guidance, videos, instructions or related content.

You are responsible for exercising safely and within your own ability.

You must choose suitable weights, intensity, modifications, equipment, space, footwear, warm-ups, technique and recovery based on your own circumstances.

You must stop immediately and seek medical advice if you experience pain, dizziness, chest pain, shortness of breath, faintness, unusual symptoms, injury, distress or if you feel unsafe.

NEUFORM is not responsible for injuries caused by unsafe exercise, poor technique, unsuitable equipment, unsuitable environment, ignoring pain or symptoms, failing to warm up, failing to modify exercises, overtraining, or failing to obtain medical or professional advice.

15. No Guarantee of Results

NEUFORM does not guarantee any specific result, transformation, weight loss, fat loss, muscle gain, performance improvement, body composition change, health outcome, fitness outcome, confidence improvement or lifestyle outcome.

Your results may depend on factors including:

a. your starting point;

b. genetics;

c. age;

d. sex;

e. health status;

f. medical history;

g. medication use;

h. injury status;

i. adherence;

j. food tracking accuracy;

k. training effort;

l. sleep;

m. stress;

n. alcohol intake;

o. social commitments;

p. metabolism;

q. hormones;

r. lifestyle;

s. consistency;

t. honesty in check-ins;

u. whether you follow the plan; and

v. factors outside NEUFORM's control.

Testimonials, before and after photos, examples, case studies and previous participant results are examples only and are not guarantees that you will achieve the same or similar result.

16. Support

Challenge support is provided through:

a. in-app chat; and

b. email.

You can contact support at support@neuform.au.

Email and in-app chat are the official communication methods for the Challenge. You are responsible for checking your email and in-app messages regularly during the 8 week access period.

NEUFORM will make reasonable efforts to respond to support messages during business hours. Response times are not guaranteed.

Support is not available for emergencies, crisis situations, urgent medical issues, mental health emergencies, injury emergencies or safety issues.

17. Not an Emergency Service

NEUFORM is not an emergency, crisis, medical, mental health or urgent support service.

You must not treat NEUFORM chat support, seminars, livestreams, meal plan updates, check-ins or community forum responses as urgent support.

If you feel unwell, unsafe, injured, distressed, at risk, or require urgent help, you must stop participating and contact emergency services or an appropriate qualified health professional.

In an emergency, call 000 in Australia.

18. Seminars, Webinars and Livestreams

NEUFORM may provide seminars, webinars, livestreams, recordings or educational sessions during the Challenge.

These sessions are for general education, motivation, support and guidance only.

Any answers given during seminars, webinars or livestreams are general in nature unless NEUFORM clearly states otherwise.

You must not rely on seminar, webinar or livestream content as medical advice, dietetic treatment, psychological advice, diagnosis, treatment or individual healthcare advice.

NEUFORM may reschedule, cancel, replace, modify or remove seminars, webinars or livestreams where reasonably necessary.

You must not record, copy, download, reproduce, distribute, post or share seminars, webinars or livestreams unless NEUFORM gives written permission.

19. Community Forum

The Challenge may include access to a community forum or group.

You must use the community respectfully and lawfully.

You must not post, share, upload or send content that is:

a. abusive;

b. threatening;

c. harassing;

d. bullying;

e. discriminatory;

f. defamatory;

g. misleading;

h. offensive;

i. obscene;

j. sexually explicit;

k. unlawful;

l. spam;

m. promotional without permission;

n. harmful to other participants;

o. private or confidential information about another person; or

p. content that infringes another person's rights.

NEUFORM may monitor, moderate, remove or restrict community content at any time.

NEUFORM may suspend or terminate your access if you breach community standards.

You must not share private community content outside the Challenge.

20. User Content

You may upload, enter or submit information or content through the app or Challenge, including progress photos, weight, measurements, food logs, check-in answers, health information, injury details, comments, messages and community forum posts.

You retain ownership of your own user content.

By uploading or submitting user content, you give NEUFORM permission to use, store, review and process that content for the purpose of providing, managing, improving, personalising and supporting the Challenge.

NEUFORM will not use your before and after photos, testimonials, transformation results, private messages or progress updates for public marketing unless you provide separate written consent.

You are responsible for ensuring your user content is accurate, lawful and does not infringe the rights of any person.

21. Prizes and Giveaways

The Challenge may include prizes, giveaways or sponsor-provided rewards for one or more winners.

Prizes are not guaranteed to every participant.

Winners may be chosen based on NEUFORM's stated Challenge criteria, which may include participation, effort, transformation, adherence, check-ins, community engagement or other criteria announced during the Challenge.

NEUFORM's decision is final, except where otherwise required by law.

Prizes may be subject to additional terms, conditions, eligibility requirements, delivery limitations, availability, sponsor conditions or legal requirements.

Where a prize includes a sauna, ice bath, equipment, bulky goods, installation, delivery or sponsor-supplied product, that prize is only available for delivery and installation within Australia.

Participants outside Australia are not eligible to receive any prize that requires Australian delivery, Australian installation, local supplier access, site access, physical freight or sponsor delivery within Australia, unless NEUFORM agrees otherwise in writing.

The winner is responsible for ensuring that the delivery and installation location is suitable, safe and accessible. This includes ensuring there is adequate space, access, ground surface, power supply, water access, drainage, structural suitability, landlord approval, body corporate approval, council approval, strata approval, safety clearance and any other permission or requirement needed for delivery, installation and use.

NEUFORM is not responsible if a prize cannot be delivered or installed because the winner's location, property, access, approvals, site conditions, safety requirements or personal circumstances are unsuitable.

If the winner cannot accept delivery or installation within Australia, does not provide required information, does not respond within the required timeframe, is ineligible, cannot provide a suitable installation location, or cannot meet any reasonable delivery or installation requirement, NEUFORM may choose another winner or provide an alternative prize at its discretion, subject to applicable law.

NEUFORM may change, substitute or withdraw a prize if:

a. a sponsor changes the prize;

b. the product or service becomes unavailable;

c. delivery becomes unavailable or impractical;

d. installation becomes unavailable or impractical;

e. the winner's location or property is unsuitable;

f. the prize cannot reasonably be supplied;

g. circumstances outside NEUFORM's control affect the prize; or

h. another reasonable issue arises.

Where practical, NEUFORM will aim to substitute a prize with something reasonably similar in value, but this is not guaranteed unless required by law.

NEUFORM is not responsible for prize delays, defects, warranty issues, installation issues, delivery issues, supplier issues or sponsor issues outside its reasonable control.

Any warranty, maintenance, repair, defect, installation, delivery or product issue relating to a sponsor-supplied prize may need to be handled directly with the sponsor, supplier, manufacturer, installer or delivery provider.

22. Intellectual Property

All NEUFORM Content is owned by or licensed to NEUFORM.

You are given a limited, personal, non-exclusive, non-transferable, revocable licence to access and use the Content for your own personal Challenge participation only.

You must not:

a. copy;

b. reproduce;

c. screenshot;

d. screen record;

e. download;

f. upload;

g. publish;

h. post;

i. share;

j. sell;

k. resell;

l. licence;

m. distribute;

n. give away;

o. modify;

p. adapt;

q. create derivative works from;

r. teach from;

s. use commercially;

t. provide to another person;

u. use for another business; or

v. allow another person to access

any NEUFORM Content, including meal plans, macros, recipes, workouts, videos, seminars, livestreams, app content, community content, PDFs, downloads, images, graphics, templates, plans or resources.

You must not share your login details with any other person.

Any breach of this clause may result in immediate suspension or termination of your access without refund, subject to your rights under Australian Consumer Law.

NEUFORM reserves all rights to take legal action for unauthorised use, copying, sharing or distribution of its Content.

23. Account Security

You are responsible for keeping your login details secure.

You must not allow any other person to access your account.

You must notify NEUFORM immediately if you believe your account has been accessed without permission.

NEUFORM is not responsible for loss or damage caused by your failure to keep your account details secure.

24. AI Use

NEUFORM may use artificial intelligence tools to assist with administration, customer support, content preparation, meal plan creation, meal plan adjustments, check-in review, personalisation, analytics and internal operations.

AI tools may support the Challenge process, but they are not a substitute for medical, dietetic, psychological or professional health advice.

Participants remain responsible for checking information, using their own judgment and seeking advice from a GP or qualified health professional before relying on any health, nutrition, training or lifestyle guidance.

NEUFORM may review, adjust or override AI-assisted outputs where appropriate.

25. Third-Party Platforms

NEUFORM may use third-party platforms and service providers to operate, deliver, improve or support the Challenge, including Stripe, AWS, OneSignal, ActiveCampaign, Segment, RevenueCat, Apple App Store, Google Play and other providers.

You acknowledge that third-party platforms may have their own terms, conditions, policies, technical requirements, outages, fees, data handling practices and limitations.

NEUFORM is not responsible for third-party platform outages, errors, delays, security incidents, account issues, payment issues, device compatibility issues, app store issues or service interruptions outside NEUFORM's reasonable control.

26. App Access, Technical Issues and Availability

NEUFORM will make reasonable efforts to provide access to the app and Challenge content.

However, NEUFORM does not guarantee that the app, website, content, chat, community forum, videos, livestreams or third-party platforms will be uninterrupted, error-free, secure, available at all times or compatible with every device.

You are responsible for having:

a. a compatible device;

b. a stable internet connection;

c. up-to-date software;

d. correct login details;

e. access to your email account; and

f. any required app store or platform access.

NEUFORM may perform maintenance, updates, bug fixes, upgrades or changes at any time.

NEUFORM is not responsible for missed workouts, missed check-ins, missed content, missed notifications, lost data, device issues, internet issues, software issues or third-party issues outside its reasonable control.

27. Suspension and Termination

NEUFORM may suspend or terminate your access immediately if you:

a. breach these Terms;

b. abuse staff, coaches, contractors, other participants or community members;

c. harass, bully, threaten or discriminate against any person;

d. share private community content;

e. provide false, incomplete or misleading health information;

f. misuse the app;

g. copy, share, resell or distribute NEUFORM Content;

h. share your login details;

i. make a fraudulent payment;

j. initiate an improper chargeback;

k. engage in unlawful conduct;

l. act in a way that harms NEUFORM's reputation, systems, staff, participants or community; or

m. participate in a way NEUFORM reasonably believes is unsafe, unsuitable or outside our scope.

If your access is suspended or terminated due to your breach, you are not entitled to a refund except where required by law.

28. Chargebacks and Payment Disputes

If you have an issue with your payment or believe you are entitled to a refund, you must contact NEUFORM first at support@neuform.au.

If you initiate a chargeback or payment dispute that NEUFORM reasonably believes is improper, fraudulent or inconsistent with these Terms, NEUFORM may suspend your access while the dispute is investigated.

NEUFORM reserves the right to recover any fees, losses or costs caused by improper or fraudulent payment disputes, where permitted by law.

29. Limitation of Liability

To the maximum extent permitted by law, NEUFORM is not liable for any indirect, incidental, special, consequential or economic loss, including loss of opportunity, loss of enjoyment, loss of data, loss of income, loss of profits, reputational loss or personal dissatisfaction.

To the maximum extent permitted by law, NEUFORM is not liable for loss, injury, illness, reaction, harm or damage caused by:

a. your failure to obtain medical clearance;

b. your failure to disclose accurate information;

c. your failure to follow advice from your own health professionals;

d. your misuse of the Challenge;

e. your failure to check meals, ingredients or recipes;

f. your failure to exercise safely;

g. your use of unsuitable equipment;

h. your failure to stop when experiencing symptoms;

i. your reliance on general educational information as medical advice;

j. third-party platforms;

k. app outages or technical issues outside NEUFORM's reasonable control;

l. circumstances outside NEUFORM's reasonable control; or

m. your breach of these Terms.

Nothing in this clause limits, excludes or modifies any rights you have under Australian Consumer Law.

30. Indemnity

To the maximum extent permitted by law, you agree to indemnify NEUFORM, its directors, officers, employees, contractors, coaches, representatives and related entities from and against any claim, loss, damage, liability, cost or expense arising from:

a. your breach of these Terms;

b. your misuse of the Challenge;

c. your failure to provide accurate information;

d. your failure to disclose relevant health information;

e. your sharing or misuse of NEUFORM Content;

f. your unlawful conduct;

g. your community forum posts or user content;

h. your breach of another person's rights; or

i. your failure to seek appropriate medical, dietetic, psychological or professional advice.

This indemnity does not apply to the extent a claim, loss, damage, liability, cost or expense is caused by NEUFORM's negligence, breach of law or breach of these Terms.

31. Force Majeure

NEUFORM is not liable for delay or failure to perform any obligation where the delay or failure is caused by circumstances outside its reasonable control.

This may include natural disasters, illness, injury, power outages, internet outages, platform outages, cyber incidents, supplier issues, app store issues, payment provider issues, sponsor issues, government restrictions, strikes, pandemics, emergencies or other events outside our reasonable control.

32. Changes to These Terms

NEUFORM may update these Terms from time to time.

If changes are material, NEUFORM will take reasonable steps to notify participants by email, in-app notice or another reasonable method.

Your continued access to or use of the Challenge after notice of updated Terms means you accept the updated Terms.

Nothing in this clause allows NEUFORM to remove rights you have under Australian Consumer Law.

33. Privacy

NEUFORM handles personal information in accordance with the Privacy Policy section below.

By participating in the Challenge, you consent to NEUFORM collecting, using, storing and disclosing your personal information as described in these Terms and the Privacy Policy section below.

35. Governing Law

These Terms are governed by the laws of Queensland, Australia.

The parties submit to the courts of Queensland, Australia, subject to any rights a participant may have under Australian Consumer Law or other applicable laws.


Privacy Policy

This Privacy Policy explains how Chontel Pty Ltd trading as NEUFORM, ABN 76 625 118 854, collects, uses, stores and discloses personal information in connection with the NEUFORM 8 Week Challenge.

a. purchase the Challenge;

c. complete onboarding forms;

d. complete health questionnaires;

e. submit check-ins;

f. upload photos;

g. enter weight or measurements;

h. log food or progress;

j. join the community forum;

k. send in-app messages;

m. attend seminars, webinars or livestreams;

n. participate in prizes or giveaways; or

o. otherwise interact with NEUFORM.

NEUFORM may collect, use and process your information to:

a. provide the Challenge;

b. create and adjust meal plans;

c. calculate and adjust calories and macros;

d. provide recipes and training guidance;

e. deliver seminars, webinars and livestreams;

f. provide check-ins;

g. provide in-app chat support;

h. manage your account;

i. process payments;

j. manage refunds and disputes;

k. personalise your experience;

l. monitor progress;

m. provide customer support;

n. operate the community forum;

o. improve the app, Challenge, systems and content;

p. manage safety, suitability and scope;

q. identify higher-risk participants;

r. communicate with you by email and in-app chat;

s. run prizes and giveaways;

t. conduct analytics and reporting;

u. protect NEUFORM's legal rights;

v. comply with legal obligations; and

w. operate and improve NEUFORM's business.

4. Health and Sensitive Information

NEUFORM may collect health information and sensitive information where it is reasonably necessary to provide the Challenge and where you provide that information.

This may include information about injuries, medical conditions, medication use, allergies, intolerances, pregnancy, breastfeeding, eating disorder history, mental health concerns, body weight, measurements, progress photos, goals and check-in responses.

By providing this information, you consent to NEUFORM collecting, using, storing and disclosing it for the purposes described in this Privacy Policy.

If you do not want to provide health or sensitive information, NEUFORM may not be able to provide personalised meal plans, macros, check-ins, adjustments or support.

5. Artificial Intelligence

NEUFORM may use artificial intelligence tools to assist with administration, customer support, content preparation, meal plan creation, meal plan adjustments, check-in review, personalisation, analytics and internal operations.

Information entered into AI-assisted systems may be used to support delivery of the Challenge.

NEUFORM will take reasonable steps to use AI tools responsibly and to avoid unnecessary disclosure of sensitive information where practical.

AI tools are used as support tools only and do not replace professional health, medical, dietetic or psychological advice.

6. Third-Party Providers

NEUFORM may disclose or process information through third-party providers that help us operate the Challenge.

These may include:

a. Stripe for payments;

b. AWS for storage, hosting or infrastructure;

c. OneSignal for push notification systems;

d. ActiveCampaign for email communication;

e. Segment for analytics;

f. RevenueCat for app access or subscription-related systems, if used;

g. Apple App Store and Google Play where relevant;

h. app developers, contractors, support staff and technical providers;

i. dietitians, nutrition professionals, health coaches or fitness coaches assisting with the Challenge; and

j. other service providers reasonably required to operate NEUFORM.

NEUFORM uses Stripe to process payments. When you make a payment, Stripe may collect and process personal information, payment information, transaction information, device information, fraud prevention information and other information required to process, verify and protect payments. NEUFORM does not store your full credit card or debit card details.

Third-party providers may store or process information in Australia or overseas.

By participating in the Challenge, you consent to NEUFORM using third-party providers to process your information for the purposes described in this Privacy Policy.

7. How We Use Your Information for Communication

NEUFORM may contact you by:

a. email; and

b. in-app chat.

We may contact you about Challenge access, support, onboarding, check-ins, meal plans, adjustments, seminars, livestreams, community updates, payment issues, refund requests, important notices, legal notices and service updates.

You are responsible for checking your email and in-app messages regularly during the Challenge.

8. Marketing

NEUFORM may use your contact details to send marketing emails or updates about NEUFORM products, services, challenges, promotions or offers where permitted by law.

You can unsubscribe from marketing emails using the unsubscribe link or by contacting support@neuform.au.

NEUFORM will not use your before and after photos, testimonials, private messages, transformation results, progress updates or personal story in public marketing unless you provide separate written consent.

9. Storage and Security

NEUFORM takes reasonable steps to protect personal information from misuse, interference, loss, unauthorised access, modification or disclosure.

However, no app, website, email system, cloud system, payment provider, AI tool or internet transmission can be guaranteed to be completely secure.

You are responsible for keeping your login details secure and notifying NEUFORM if you believe your account has been accessed without permission.

10. Access and Correction

You may contact NEUFORM to request access to or correction of your personal information.

NEUFORM may need to verify your identity before responding.

NEUFORM may refuse access or correction where permitted by law.

11. Data Retention

NEUFORM may retain your personal information for as long as reasonably necessary to provide the Challenge, manage records, comply with legal obligations, resolve disputes, protect legal rights, improve services and operate the business.

NEUFORM may retain some information after your Challenge access ends where reasonably necessary for legal, accounting, tax, insurance, dispute, compliance or business record purposes.

NEUFORM may disclose your personal information if required or permitted by law, including to regulators, courts, law enforcement, professional advisers, insurers, payment providers, dispute bodies or other parties where reasonably necessary.

Some third-party providers used by NEUFORM may store or process information outside Australia.

By using the Challenge, you acknowledge that your information may be processed through systems located in Australia or overseas.

Your continued use of the Challenge after notice of the updated Privacy Policy means you accept the updated Privacy Policy, subject to your rights under applicable law.
